South Carolina Home Story-Telfair, Lady's Island SC

First, I love the drive from Bluffton to Lady's Island.  As you ride through along RT 802  you see there is a lot going on--roads being widened and new housing being constructed. As you cross the bridge on to Lady's Island, you'll see more of the same--but it's a different world. There aren't as many transplants from the Northeast here. Most of the people here have lived in the area all of their lives. There are also many  Military families who call Lady's Island home.

I was fortunate to meet one such family and was invited into their home. The Gross family lives at 21 Telfair Dr in the Telfair subdivision. Husband Gary is a Master  Sergeant and serves at MCAS. He is married to Sheila. They have two children.

The Telfair neighborhood is ideal for families. It is unique in that it is one of the few neighborhoods that are established--with fairly new homes, that are  close toLady's Island schools. For those who are in the military, it's a short drive to Marine Corps Air Station, The Beaufort  Naval Hospital and Parris Island, SC

Let's start from the outside of the home. There's a huge backyard with plantings that dot the perimeter of a privacy fence which circles the yard. A trampoline and an above ground pool sits off to the left side of the yard and a "man shed" that is out of the way on the right side of  houses all of Gary's lawn gear and his tools.

As to the inside of the home--it is warm and inviting and open. I love this house! Mr. and Mrs. Gross created a wonderful video--I am impressed at their creativity and initiative--and Mrs. Gross would make a fantastic real estate agent!

Sometimes our lives can feel like and look like a car wreck--There is always hope.

Maybe TRUSTING AND BELIEVING  like a Five Year Old is worth a try...

EdVenture Children's MuseumAbout a month ago my daughter Megan and I were going to the Edventure Children's  Museum here in Columbia, SC to see the New Curious George exhibit.

On the way, we were involved in an accident that left our car on it's passenger side and glass everywhere.

It happened so fast, I didn't even see the Jeep coming. When our car stopped moving it somehow was up on the sidewalk between a light pole and it's guideline -not touching either one. Megan is always strapped in her booster seat in the middle of the backseat of the car.  I looked back as much as my locked-down seatbelt would let me and I expected to see her hurt.

I asked "Megan are you okay?!"

     She answered in her wannabe teenager voice, "Daad, I'm hanging upside do - owwnn." Not upset at all, not yelling, screaming, or even crying.

I looked past her head and saw that the back windshield was somehow shattered away from the car and the beachball we keep in the car to play with at the park was wedged between the side of her headrest and the back passenger-side window that remained intact. Within seconds, a lady appeared at the back windshield and asked if she could help Megan out of the car. I asked her if there was any glass that could cut Megan on the way out and the lady said that it was all gone.

So I told Megan it was okay to go with the ladyMegan Grace and I would be right out. I stretched back under my seatbelt to push her release button on her booster seat and Megan went out with the lady.

By that time about 3 guys had opened my driver's door that was up in the air (since we landed on the passsenger side) and pulled me out of the car. I ran to the other side of the car to find Megan was in the arms of the same lady as calm as a cucumber. I picked Megan up and checked her over to find she didn't have a scratch, lump, or mark on her. I kept cheking her scalp all over her head to make sure I did not see any glass or cuts - not believing that we had escaped this accident without any injuries. 

I called my wife and explained we had been in a car acident.

After I checked Megan out, an EMT who goes to our church arrived and checked Megan out again. When she had thoroughly examined us she said, "I don't see anything wrong with either of you."  About that time my wife arrived (the accident happened within 3 minutes of our home) and was crying when she saw the car on it's side,  expecting to see us badly injured (even though I had told her on the phone we were okay). She picked up Megan and hugged her tight then began checking her over from head to toe just like the EMT and I did.

Megan said , "Mommy why are you crying?"

    My wife said, " Because after I saw how  the car was wrecked I expected you to be hurt very bad."

 

With Permission from www.joyfultoons.comMegan just calmly replied in her best DUH voice, "God takes care of us - of course we are okay." As if she never doubted that God would keep us from harm.

The EMT, cops, and firefighters on the scene said that we would be very sore the next day and to expect some deep bruises where our seatbelts had caught us; however,  Megan and I have had no soreness or bruising at all.

The lady who helped Megan out of the car turned out to be my Mother-In-Law's Pastor's wife who lives across the street from the accident site. She told my Mother-In-law the folllowing week that when she had helped Megan out of the car,  Megan hugged her tight and asked in a normal voice, "Will you take care of me until my Daddy gets out of the car?"

The Pastor's Wife said that it truly was a Miracle that we came out of that accident without a scratch -especially since a lady who was involved in an accident at that same intersection the month before died at the scene.

How awesome is it for a 5 year old to know and have complete trust that God takes care of us even during a car accident?!! 

Megan asked me recently before we prayed one night, "I know God takes care of us, but why did he let us get into an accident?"

     I answered, "Only God knows for sure, but maybe it was so everyone there after the accident could see that God kept us from getting hurt when we should have been hurt very bad -or maybe it was so that they could see how calm you were because you knew that God takes care of us."

Even the Experts are Buying Homes

 If you plan on staying in a home for 5 to 7 years, buying is a wise option. If not, renting may be the best option.

Home prices have hit bottom in most areas of the country, but they're not like a rubber ball. Sellers can't expect much of a bounce. Homes for Sale

At the Center for Economic Policy Research, in Washington D.C., analysts are predicting that the pricing arrow is pointing up, but not very far. There are still too many foreclosed homes on the market.

So, what did the center's co-director do? He bought a house. He doesn't expect its value to rise much in the foreseeable future. But the home had features he loved. The price was affordable, and the loan's interest rate was below 5 percent.

This set of circumstances encouraged him to take the plunge and acquire a place his family could call home for many years to come.

Today's reasonable prices can make a good case for buying rather than renting, say advisors quoted in USA Today. While many first-timers are leery of making a long-term contract, here is a way you could determine if the move is a wise one.

Homes Sold* Divide the price of a home you are considering by the annual rent for a comparable place. If the number falls below 15, buying starts to look like a good idea.

* Consider whether you will stay in the home long enough to make the purchase worthwhile. Closing costs are high. If you intend to sell the house and buy another in two or three years, you could take a loss.

* Analysts say it's reasonable to buy a home only if you plan to stay in it for five to seven years.

It seems that you can barely turn on the news without hearing about how "The Market" has taken another victim. It seems this market has been indiscriminately targeting sellers and their agents and casting hexes on them. Their homes have been sitting for sale for weeks and months and years without any visits or offers. Certainly, they must be "victims" of the market! Right?

What do we know about victims?

1.  They think that they have no responsibility in their fate. Whatever it is, it has happened to them.

2.  They think that there is nothing that they could have done to prevent the outcome from happening. Their actions did not affect the results.

3.  They always have something else to blame their fate on. (The market, the weather, their agent, their neighbor, etc.)

Vancouver WA Real EstateI hate to be the bearer of bad news but, if you have a home that has been sitting on the market for weeks and months and years without any visits or offers, you either need to start listening to your Realtor® or get a new agent.

The answer to your dilemma is quite simple. You are either over priced or the condition of your home doesn't warrant the price that you are asking. (i.e.; You are over priced!) There are a huge number of homes selling in this market and some are selling in just a few short weeks.

Don't be a victim! If your home isn't selling, then you need to do one of two things: listen to your agent's pricing recommendations or find a new agent! There are no victims of the market. There are only sellers who sold their homes and sellers with over priced homes. Which do you want to be?

Positive Economic News: Home Prices Rise--Eleven of 20 cities tracked showed gains

In line with expert's estimates, the The Standard & Poor's/Case-Shiller home price index rose by 0.4 percent.

This was the 5th month in a row for an increase.  But, the index was lower by 7.3 percent from October last year. 

The index is now up by 3.4 percent from its May bottom but is below it's April peak yy 30%in April 2006. Only 11 of the 20 cities tracked in the report showed gains.

Reports showing an increase in durable goods orders and a decline in claims for unemployment benefits helped spur the market higher last week. On Monday, investors were encouraged by a jump in retail sales.

Consumer Confidence Grows

Consumer spending is the key to our economic growth.The better consumers feel about the economy, the more likely they are to spend.

Economists expect the consumer confidence index to rise to 52 in December from 49.5 in November's. The years low of 25.3 was set in February. A reading above 100 is a sign of stronger growth.

S.C. Homebuyers: HUD's Home Loan Pamphlet

HUD Shopping for a Home Loan PamphletIn my previous post I wrote about the new RESPA regulations.

Here's a Quick Recap of The Recent Changes in RESPA (The Real Estate Settlement Protection Act)

  1. A new form replaces the one page Good Faith Estimate previously provided. Typical of regulatory agencies--the new form is now 3 pages--it used to be just 1.
  2. There will be greater transparency when it comes to closing costs.
  3. The new form and regulations will make it easier for the consumer to shop
The Loan Orginator or Mortgage Broker is required tro give you the "Shopping for Your Home Loan phamplet within 3 days of applying for a mortgage.

This pamphlet gives consumers a digest of the new law and what they should expect from Loan Originators and Mortgage Brokers. Much of it is very good information with clear explanations.
 
There are two areas I'd like to address in the pamphlet--The role of real estate agents and the role of attorneys:

 (direct quotes from this pamphlet)

1-Page #_6_Role of the Real Estate Agent or Broker--"Frequently, the first person you consult about buying a home is a real estate agent or broker. Although these agents and brokers provide helpful advice, they may legally be representing the interests of the seller and not yours."

Does this Apply in S.C.?

In South Carolina, an explanation of agency law is required. It is to the home Buyer's advantage to be represented EXCLUSIVELY by ONE real estate broker.

Bottom line, when a home buyer doesn't have an exclusive buyers agency agreement in force, the real estate agent who is showing you properties represents the interests of the SELLER.

2-Page#_6_ Real Estate Broker Offers to Help Home Buyer Get a Mortgage

The pamphlet reads as follows: "Sometimes, the real estate broker will offer to help you obtain a mortgage loan. He or she may also recommend that you deal with a particular lender, mortgage broker, title company, attorney, or settlement/closing agent. You are not required to follow the real estate broker‟s recommendation, and you should compare the costs and services offered by other providers before making a decision."

Does this Apply in the Beaufort County Area of  S.C.?

Most agents don't "recommend" a specific lender or loan originator--they typically provide a list of professionals to choose from--there is nothing that obligates a home buyer to use anyone from the list.

3-Page#_6_Role of an Attorney

The Pamphlet reads as follows: "Before you sign a sales agreement, you might consider asking an attorney to review it and tell you if it protects your interests. If you have already signed your sales agreement, you might still consider having an attorney review it.

Hilton Head Area Association of Realtors Has a Standardized Purchase Agreement--They spent many man-hours creating a clear standardized purchase agreement that is in the best interests of all parties.

Caveat: If you must discuss the terms and conditions specified in this standardized purchase agreement you may by all means seek out the advice of a qualified attorney: that would be an attorney who specializes in real estate law. Those who do not specialize in the practice of real estate law can cause all kinds of delay.

The Pamphlet further states, that "If choosing an attorney, you should shop around and ask what services will be performed and whether the attorney is experienced in representing homebuyers.

What's the normal practice in the Beaufort County Area?

In the Beaufort County area, Escrow Services are handled by real estate attorneys who specialize in real estate transactions. They will do title searches,get title insurance, get mortgage information together from the lenders involved to enable a closing, prepare HUD-1 statements, etc.

The real estate professional is charged with insuring that all of the various tasks necessary for closing the real estate transaction are accomplished. He or she will coordinate activities, help to facilitate scheduling of tasks and follow up to insure that the transaction is on track to close.

The real estate professional is also responsible for the accuracy of the HUD-1. Attorneys are to provide a copy of the HUD-1 48 hours before closing for this review.

My advice to  any homebuyer interested in purchasing a home in the Beaufort County Area is to become as knowledgeable as you can and seek the advice of competent real estate professionals.

You can then discuss your questions with them and get the very best advice.

New RESPA Regulations Protect Consumers-- in effect on January 1, 2010

Beaufort County, South Carolina Homebuyers, it is important to be aware of these changes, since--according to HUD-- these new regulations are to your advantage. And --we are told--you might save on average $700 on your closing fees. 

BUT HONESTLY--I am not going to bet on that! From my point of view, the more regulation we have, the more complicated it gets for all involved in a real estate transaction. Most of us are well aware that estimates on "saving money" that come  from a governmental agency is highly questionable.

In the name of keeping everyone honest and protecting the consumer, most of us know, the reverse is often the case.  My hunch is that it will take longer to close a real estate transaction then previously. It is tough enough getting financing. The last thing we need are regulations that bog us down. Be that as it may--here's the deal...

What is RESPA?

RESPA is the acronym for  the "Real Estate Settlement Protection Act" 

The Real Estate Settlement Procedures Act (RESPA) was enacted in 1974. It's purpose was to provide consumers protection from excessive fees by reducing closing costs associated with financing the purchase of homes. This was done by promulgation more transparent disclosures of settlement costs. The law was also designed to prevent loan originators and others involved in a transaction from giving and or receiving referral fees and kickbacks.

The Department of Housing and Urban Development (HUD) is directly involved in the  issuance of regulations and provides RESPA guidance to industry and consumers alike.  

What Do The Changes if RESPA do for you?

On November 17, 2008, HUD published a new final rule “To Simplify and Improve the Process of Obtaining Mortgages and Reduce Consumer Settlement Costs” and has revised the RESPA rules which mandate the use of a new Good Faith Estimate (GFE) and HUD-1 which go into effect on January 1, 2010.

Brief Overview of the Home Buyer Tax Credit Program and Benefits

Interested in purchasing a home in Bluffton, Beaufort and Hilton Head areas of  SC?  Maybe you QAULIFY to take advantage of the recent Home Buyer Tax Credit Program Extension--

Here's a brief overview:

The Tax Credit Benefits will Help those who areIt is dollar-for-dollar benefit, not a tax deduction which would reduce a tax liability which would yield less in actual dollars in your pocket. In effect, a  homebuyer who qualifies for the entire benefit and owes $8,000 in income taxes would owe nothing to the IRS.

Keys to Future HomeSecondly, homebuyer who qualifies for the $8000 credit or the $6500 credit would receive a check from the treasury for the difference between their tax liability and any used credit. For example, if a first-time homebuyer is eligible for a tax credit of $8,000 and has a tax obligation of  $4,000 in income taxes, the treasury will issue a check for the difference of $4000 to the homebuyer.

Who can take advantage of the tax credit?

1-First-Time Homebuyers 

Who may qualify as a first time homebuyer? Those who have not owned a home, within the last three years.  Both single and married tax payers who file jointly may qualify for the full tax credit.

The amount of the Tax credit for First-Time Homebuyers  is 10% of the purchase price of the home. The maximum credit allowed under the new law is $8000.

2-Current Homeowners

To qualify for this The tax credit program, home owners must have occupied a home for a period of five consecutive years for the last eight years. This home must have been a primary residence--vacation homes and investment properties do not qualify. Qualified purchase may receive a tax credit of up to $6500.

Other Qualification Stipulations

  • Maximum Purchase Price  of any home cannot exceed $800000
  • Single Tax Filers who earn up to $125000 are eligible for the full amount of the tax credit
  • Single Tax fliers who earn in excess of $125000 up to $145000 are eligible for prorated tax credit 
  • Single Tax fliers who earn in excess $145000 do not qualify for the tax credit
  • Joint Tax Filers who earn up to $225000 are eligible for the full amount of the tax credit
  • Joint Tax Filers who earn up in excess of $225000 up to $245000 are eligible for prorated tax credit
  • Joint Tax Filers who earn $245000 or more are not eligible

DEADLINES

All purchase contracts must be effective, no later than April 30, 2010 and must close no later than June 30, 2010. There are extensions for those in the military
